The book explores the emerging field of constitutional economics, which examines the intersection of constitutional law and economic analysis in relation to the development of economies and the protection of citizens' constitutional rights and freedoms. Originating in the United States in the late 20th century, constitutional economics gained recognition in 1986 when its founder, economist James Buchanan, was awarded the Nobel Prize.
The Russian school of constitutional economics has also made significant contributions to the field, led by prominent figures such as Vladimir Mau, the rector of the Academy of National Economy under the Government of the Russian Federation, Oleg Kutafin, the rector of the Moscow State Law Academy, and Gadis Gadzhiev, a judge of the Constitutional Court of the Russian Federation. These esteemed individuals established the Laboratory of Constitutional Economics at the Higher School of Economics, as well as the Constitutional Economics Laboratory at the Institute for the Economy in Transition.
The book delves into the various aspects of constitutional economics and its implications for the Russian legal and economic systems. It examines the philosophical foundations of constitutional economics, highlighting the role it plays in shaping legal thought in the 21st century. The collection of articles, edited by Gadis Gadzhiev and published by the Moscow-Petersburg Philosophical Club, provides valuable insights into this interdisciplinary field. Additionally, the book presents a compilation of essays discussing the relationship between the philosophy of law, constitutionalism, and constitutional economics.
Previous publications by "Justicinform" have explored constitutional economics in depth. These include textbooks for both economic and legal universities, educational materials for schools, and a series of articles specifically focused on the role of the Central Bank of Russia from the perspective of constitutional economics. This comprehensive book is an essential resource for scholars, researchers, and students interested in understanding the theoretical framework and practical implications of constitutional economics in both the United States and Russia.
